Terms of Service
Agreement
These Terms of Service ("Terms") govern your access to and use of the services provided by 7+9 LLC ("7+9," "we," "us," or "our"), including the 7plus9.com website and the 7+9 platform accessible at portal.7plus9.com (together, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Services.
The Services
7+9 provides AI assistants, custom business software, communication tools (including SMS and voice), and related professional services. The specific features available to you depend on your subscription plan and any service agreement between you and 7+9.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable. We are not liable to you or any third party for any modification, suspension, or discontinuation.
Accounts
To access certain features, you must create an account. You are responsible for:
- Providing accurate and complete information when registering.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us promptly at support@7plus9.com if you suspect unauthorized access.
You may not share your account credentials or allow others to access the Services through your account without authorization.
SMS and Telephony Messaging
Opt-in consent: By providing your phone number and opting in — through platform sign-up, by texting START, or by expressly agreeing in writing — you consent to receive SMS and MMS messages from 7+9 for account notifications, service updates, and support communications.
Consent is not a condition of purchase. You may use our Services without consenting to receive SMS messages where SMS is not required for the service.
Message frequency: Message frequency varies based on your account activity. Typical use includes account alerts, security notifications, and support follow-ups.
Message & data rates: Standard message and data rates charged by your mobile carrier may apply to messages sent and received.
Opt out: Reply STOP to any text message at any time to unsubscribe. You will receive a one-time confirmation and no further messages will be sent. To re-subscribe, reply START.

Supported carriers: Major US carriers. Carrier availability and message delivery are not guaranteed. Carriers are not liable for delayed or undelivered messages.
When you use the SMS or telephony features of the platform to message your own contacts, you represent and warrant that you have obtained all necessary consents from those recipients and that your use complies with applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
Acceptable Use
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates applicable federal, state, local, or international law or regulation.
- Send unsolicited, deceptive, or harassing messages (spam) via the SMS or telephony features.
- Transmit content that is illegal, fraudulent, defamatory, obscene, or infringes any third-party rights.
- Attempt to gain unauthorized access to any part of the Services or to another user's account.
- Interfere with or disrupt the integrity or performance of the Services.
- Use the Services to collect or store personal data in violation of applicable privacy laws.
- Reverse-engineer, decompile, or disassemble any software used in the Services.
- Resell or sublicense the Services without written authorization from 7+9.
We reserve the right to suspend or terminate access for any user who violates these terms without notice.
Intellectual Property
The Services, including all software, content, designs, trademarks, and logos, are owned by 7+9 or its licensors and protected by intellectual property laws. Nothing in these Terms grants you any right to use the 7+9 name, logo, or trademarks without prior written consent.
You retain ownership of content you submit to the Services. By submitting content, you grant 7+9 a limited, non-exclusive license to use, store, and process that content as necessary to provide the Services to you.
Payment and Billing
Fees for paid features are specified in your service agreement or subscription plan. Unless otherwise stated:
- Fees are billed in advance on a recurring basis.
- All fees are non-refundable except as required by law or explicitly stated in your agreement.
- You are responsible for all taxes applicable to your use of the Services.
- Failure to pay may result in suspension or termination of your account.
Confidentiality
Each party may have access to confidential information of the other in connection with the Services. Each party agrees to protect the other's confidential information using at least the same degree of care used for its own confidential information (but no less than reasonable care), and not to disclose such information to third parties without prior written consent, except as required by law.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 7+9 DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 7+9 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
In no event will 7+9's aggregate liability for all claims relating to the Services exceed the greater of (a) the amount you paid to 7+9 in the twelve months prior to the claim, or (b) one hundred dollars ($100).
Indemnification
You agree to defend, indemnify, and hold harmless 7+9 and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.
Termination
Either party may terminate the relationship governed by these Terms at any time. We may suspend or terminate your access to the Services immediately, without prior notice or liability, if you breach these Terms or we reasonably believe your use creates risk for us or other users.
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimer, limitation of liability, and indemnification.
Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. 7+9 operates primarily in Wisconsin and Florida. Any disputes arising under these Terms that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Wisconsin, and each party consents to personal jurisdiction there.
Before initiating any formal legal proceedings, you agree to contact us at support@7plus9.com and give us a reasonable opportunity — not less than 30 days — to resolve the dispute in good faith.
Wisconsin Residents
Wisconsin residents may have additional rights under the Wisconsin Consumer Act (Wis. Stat. §§ 421–427), the Wisconsin Deceptive Trade Practices Act (Wis. Stat. § 100.18), and other Wisconsin consumer protection statutes. Nothing in these Terms is intended to, nor shall it operate to, waive any right you may have under Wisconsin law that cannot be contractually waived.
Florida Residents
Florida residents may have additional rights under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.), the Florida Digital Bill of Rights (Fla. Stat. §§ 501.701–501.721), and other applicable Florida consumer protection laws. Nothing in these Terms is intended to waive any right you may have under Florida law that cannot be contractually waived. Florida consumers may also contact the Florida Department of Agriculture and Consumer Services at fdacs.gov with complaints.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and notify you by email or through the Services. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
